Another obstacle in Nirbhaya’s case

New Delhi– The Nirbhaya gang-rape and murder case is facing another obstacle.A Delhi Court on Tuesday, reserved its order on a plea filled by one of the convicts of Nirbhaya gang rape and murder, Mukesh Singh-seeking countermand of death penalty by claiming that he was not in Delhi when the crime was being committed.

Additional Sessions Judge Dharmendra Rana reserved his order after listening from both the sides.

Advocate ML Sharma, appearing for Mukesh Singh, claimed that Mukesh was arrested from Karoli,  Rajasthan on 17th December 2012. He further claimed that the prosecution has fraudulently withheld the documentation carried out by Delhi and Rajasthan police.

 

“If the prosecution has not withheld the document then Mukesh would have pronounced innocent by the court.”

While on the other hand, Special Public Prosecutor Rajiv Mohan and Public Prosecutor Irfan Ahmad opposed the plea stating that Mukesh filled the application with impish attempt to obstruct the death sentence scheduled on March 20.

The prosecution also asked the Court that Mukesh’s application is without merit and should be dismissed.

All the four convicts Mukesh Singh, Pawan Gupta, Akshay Singh Thakur and Vinay Sharma are scheduled to be hanged on March 20 at 5:30 a.m

The case prevailed when a 23-year old paramedical student was brutally gang raped and murdered by six people including a juvenile, in a moving bus. The girl died at Singapore hospital after few days.
